If you're going to pontificate about legal matters at least get it right.

The suspect has a right to request a blood test if the breath sample is only marginally above the legal limit.(Below 40 I think - legal limit 35)

If however he has already been charged that would tend to suggest that he either did not request a blood test, or that if he did, it confirmed the reading on the breath test. Could you please advise how quickly would that blood test be processed. Thanks.

Would we all be demanding we sack Phil Jones if he was caught drink driving. ?

exactly.. thats the acid test...

on moral grounds, i wouldnt be against sacking him for it, but its not going to happen.

he might be sacked by this time next week anyway, regardless of if we stay up.

i despise anyone who drink drives, oh and the axe got caught 2 or 3 times didnt he ???

I'm not suggesting he should be sacked *just* for this but it's the straw that breaks the camel's back for me.

He's been here six months and already managed to upset at least 75% of the fan base. Five minutes after a decent point against Man Utd it was more than apparent other results had not gone our way. An appropriate response to this isn't getting on the Vino with Sir Alex and hopping in his car to drive home, presumably with that pleased as punch look still on his chevy chase.

What message is that sending to the fans and the players? Job well done lads, left a bottle for you in the changing room.

He's been on thin ice since he took over. Nicko was of the view there are plenty of people waiting to trip him up. I don't doubt that's true but combined with signing our Myles that's two *self inflicted* forehead slapping misjudgments in half a season before we even get to talk about his record. Any sensible person in his position would be keeping a low profile.

Fast becoming a liability on and off the pitch.

I know people who have both been sacked and retained by various organisations when found guilty of drink driving.

IMO, it's very straightforward. Kean, as any other PL manager, is in a 'privileged' position and more often or not, is the very public face of the club. He will be paid enormous sums of money compared to supporters and many associated to the club; he therefore, has a responsibility to set standards and lead by example and he has therefore, if guilty, lost the moral ground to do this. Clearly, these type of things will hurt the club's image from top to bottom and even to the recruitment of potential youngsters from the age of 8 upwards to the various Academy sections.

Irrespective of his ability, or lack of it, I believe that his position is now untenable.

To give an accurate and correct answer to the dilemma, these are the facts.

A breath alcohol reading of 39mcgs alcohol per 100 mls of breath or below is a warning and the driver is allowed to leave. A reading of 40 - 49 when given at the stationgives rise to the offer of taking a blood sample. If the sample offer is taken, then 2 matching samples are taken by a doctor and one is sent of for analysis, the second is offered to the suspect for them to undertake a similar test should they decide to do so. The suspect is then bailed usually for 6 weeks to allow the sample to be tested. If the suspect refuses the blood sample offer then they are charged with driving with excess alcohol.

A reading of 50 + gives rise to an immendiate charge and bail when sober to the next suitable court date.

KEAN ADMITS FALSE IMPERSONATION CHARGE

By PA Crime Reporter Jack Slipper

Blackburn Rovers manager Steve Kean admitted false impersonation of a football manager when he appeared before Blackburn magistrates this morning.

Kean, who was arrested on Saturday evening on drink-drive charges, told the court he had always fancied being a football manager despite having no qualifications and no experience. He said he saw his chance when Sam Allardyce was sacked and persuaded the Rovers owners to give him the post.

The court heard however that Rovers officials suspected Kean might not be up to the job when the club won only three matches in five months and plummeted down the league table.

Kean told the court he had had delusions of grandeur since childhood. "I pretended to be Jock Stein when I was a kid," he said. "Then I thought I was Bill Shankly and then I thought I could be the next Owen Coyle."

"Despite standing in the dock this morning I still think I'm in a good place and I'm on course and I'm still positive".

Magistrates were advised by court clerks that Kean could not be prosecuted for psycho-babble.

Kean will appear before Preston crown court next month for sentencing. The charge carries a maximum fine of £5 with a £3 million pay-off.

Drink driving is wrong, full stop.

Understand I'm making these as observations (below) and it's not my opinion of what should happen.

In this case, the profile of the man and the job makes it worse as he is seen as a 'role-model' and as a manager of a Premier League club is in the public eye almost constantly. He's brought Rovers name into disrepute whether it was a mistake or not and that could cost him his job. It is, and can only be seen, in that light. The difference between Kean and your average 'Joe' is that of his position. If a member of the government was caught drink driving, he'd be in big trouble these days and the same goes for anyone in the public eye. Ten years ago that wouldn't have been the case. How Rovers and Venkys deal with this is going to be interesting to watch. It really all depends on how this plays out in the press and in court. It also depends on how much he was over the limit; that part is key. Two glasses of wine might put him over the limit and get him a slap on the wrist and a years ban, two bottles would get him sacked I would expect.

Brilliant and not a mile from the truth either!!

With Kean being charged suggests that the reading was above 60 (I think). Anything between this and 35 he would be offered the chance to provide a blood or urine test. This would mean that he would be given bail by the police until the results were available. This can sometimes take up to a month. So reading between the lines I would think the reading may well be above 60 as he has already been charged with the offence.

What sort of role model does this make Kean to the players and youngsters at the club?

This is further embarrassment the club after a tonk season.

Phil Jones is a player and not a manager. Even though Phil Jones may have an image to present to younger people etc - Kean is in a position of authority - which in my view is the difference.

I know people who have both been sacked and retained by various organisations when found guilty of drink driving.

Very possible - but also an excuse to get rid for less compo.

He's been stupid and will be dealt with by the courts accordingly and quite right too.

Anything more than this is just knee-jerkism to fuel already ingrained antipathy to Kean...

I wouldn't have a problem if Kean is sacked in the summer as a response to results but I would have a problem if he was sacked for this.

Some on here are so sanctimonious it's embarrassing.

I wonder why Kean was stopped? Was it erratic driving, speeding, involved in an accident, or do the Police still have Suss?

He was stopped for impersonating a football manager. Maybe aiding and a betting the murder of a football club, in posession of an offensive weopon - namely a combe, when obvious to all he does not need one. Last but not least pretending to be a sexual organ, namely a pri--.

I say all this in jest of course.
