I've worked with two people who were sacked for gross misconducted after drink driving, neither required a licence to do their job (though it made it much less convenient for them), I honestly believed it was the norm at most companies these days ?

This FOI request seems to agree that the Met sack people for drink driving offence http://www.met.police.uk/foi/pdfs/disclosure_2011/february/2011010000829.pdf (though is seems a few get by with a formal warning). I know there is a world of difference being employed by the met and by Rovers, but it was the first hard data I found.

Paul is correct, it is not an automatic gross misconduct unless your Contract of Employment states that you need a driving licence. I have represented a number of people in this situation. Indeed if the employee needs to use a car to carry out the functions of their job and can provide alternative means of transport at their own cost and with nil impact on the employer then they cannot be fairly dismissed (trust me, it happens, people get taxi's, chauffers etc etc).

If SK is dismissed then he will probably have an Unfair Dismissal claim. If he wins and is on a fixed term contract then the value of the contract is paid up, if he is on an open ended full time contract then the maximum compensation is less then £70K.

I suspect that most want SK sacked due to: footballing reasons; he lied to the police and therefore cannot be trusted; he tried to blame fans for spiking his drink; he is a poor role model?

Not true Glenn.

I know personally of Prison Officer's who got done for drink driving and were allowed to keep their jobs. Now,if they're allowed to keep incarcerated those sentenced to custody then I think a Football Manager has no issues in that regard.

This feels a bit like a witch-hunt and no doubt I'll get -56 for even suggesting it but it's just how I feel.

Having said that,it does appear that Kean's position is untenable if the strength of feeling on here is a true barometer of fans' feelings.

It just feels a bit 'wrong'...like one or two others have dared to suggest I'd prefer it to be a football decision only (and I know loads of people will say in that case he should go anyway),lets at least try and keep the two issues separate.

Judging by the mood on here though I'm sure glad I'm never going to be in front of the BRFCS bench for sentencing...

I don't think it matters if he goes or not at the moment.

After all, who's really identifying targets? Are we willing to spend money? Do we actually have the wherewithal to physically obtain a player's signature and process paperwork in a timely manner so that they can play for us?

People on here are sick of him, and rightly so, I've certainly had a right gutful of him. But if we binned him, who could we get in, and with incoming transfers being rather thin on the ground, would it make any difference?

Those awkward questions aside, I would suggest that the poll reflects growing rage at Venky's and Kean, rather than any moral standpoint, or legal judgement.

I just feel a visceral hatred for both him and Venky's, I just can't help it, but at least I can admit it.

And thats how I feel too Bryan, I think someone posted the other day that if anyone was starting a business, start it in India, because if those numpties at Venkys can be successful, anyone can. They have shown no professionalism, no business acumin, havent researched the product (BRFC) and go about as if they are Royalty who only have to be obeyed, they havent shown any duty of care for our football club and the sooner they and Kean get out, the better.

Not only have they failed our Football Club and had us ridiculed throughout the football world, they (Venkys) are being viewed as idiots in their own country now.

As one member on this board told me today, if they dont sack Kean now, the media will muller them on the moral issues they profess to represent.

Sack... especially after he tried to blame the fans of the club that employs him with spiking his drink!! the man is unscrupulous and a down right liar (the liar bit borne out by him telling the police he hadn't had a drink when first pulled over).

Kean cannot and should not be sacked for drink driving UNLESS his job specifically requires him to hold a driving licence. I have to drive to do my work and would expect to be sacked if I could nit attend appointments through my own fault.

TBH those calling for Kean to be dismissed for the DD offence are wrong. If we are talking football that would be another discussion.

I think this poll and thread is at best unfortunate. I'm surprised it's been posted.

His position at the club means young players / people look up to him. I do not know if DD recorded on a CRB CHECKS. Would a person who works with kids, who has got DD conviction, be cleared for the job.

They don't have to fire him because of it but I think because he is a public figure for Rovers and represents the club it makes the organization look bad...that's not to say that other actions made by him and Venky's haven't already made the club look bad. Just comes down to who you want to represent your brand, but like someone else pointed out if he was actually a good manager we probably wouldn't all be calling for him to fired.

if/when the owners sack him, they must have a PROPER REPLACEMENT MANAGER line up 1st before they get rid of him.

Out of interest do all the people who voted yes also want Goodwillie out for separate serious assault and rape charges? And I assume they wouldn't want the club to even consider signing Barton even if he was on a free? They also must have thought it was a disgrace Diouf, Bellamy, Todd and any other player found guilty of a criminal offence ever played for the club.

I find the other 14% difficult to comprehend but await to hear their reasoned debate.

To be fair,although there's been some good stong points from the majority view you can hardly argue that some of the rest has been 'reasoned'. If you want reasoned debate you should be asking for it from all not just those in the minority...

Now after reading all the things people are saying I have been thinking about this since I have heard and have voted to get rid for both football & non football reasons but the main reasons bringing the clubs good name into disrepute for blatently lying 3 months ago knowing full well he was guilty & making it impossible so close to the end of the window it would cause massive problems to replace so close to the end of the transfer window plus also a major reason to get rid of him our shirt sponsors are the princes charity trust it will destroy our good relationship with them & will lead to inevitable problems there but I agree with seekay they would probably put Jensen in charge and that would probably turn out another disaster my 2 bits of advice would be either

1. Ring Tony Parkes cap in hand & beg him to come back & manage temporary & bring in Tugay as no.2 to learn.

2. Ring either MON/Souey/ someone experienced with Tugay as no.2.

I have to admit I have at times defended Kean he maybe not the best manager and we were hoping for someone world class but for dragging the club's good name through the mud to lie 3 months ago & timing is important & to then try to wriggle out of it in court by blaming our innocent fans is even more dispicable & for this he meeds to go there is also the fact he could have killed someone this time he was lucky noone was hurt due to his reckless actions next time could be worse & for these reasons he needs to be sacked Venkys please grow a pair of balls & get rid of baldy.

Goodwillie was found Not Guilty, very very important distinction that. Kean plead guilty (after pleading not guilty and mistaking when the season started, ensuring (intentionally or otherwise) he was convicted during the season) THEN admitted he lied to the police at the time of the arrest THEN said he believe that 2.5 glass of wine and a bottle of bud where within the legal alcohol limit.

The others, frankly, yes.

I would expect that the owners/VR/PH to be talking to managers to see whether they would come to rovers. They need to have a replacement line up before they sack Kean in my view. We need a manager with proven track record to come in. (I hope so anyway ) ;)
