[Archived] Letter which exposes the history of the Blackburn crisis

Have you read the letter? If so you missed the last paragraph.

Where does it say it that they warned Venky's this was wrong and against PL Rules. It says they don't know the player nor did they know anything about the potential transaction.

Excuse me but are you for real? This situation is exactly analagous to the West Ham and Tevez situation--a player owned not by a club but by a 3rd party, with the clear implication that the third party was an agent.

Do you remember that West Ham, in most minds, should have been deducted points which would have relegated them.?

In the end they had to pay 3(?)M quid to Sheffield Utd as compensation when Utd sued.

Finally, if an agent is in charge of transfer policy and said agent earns his money by commission, can you not see that that constitutes a conflict of interest? And that's why the FA rules don't permit it?

My joy at seeing this letter revealed is only tempered by the fear that Rovers could be in serious trouble because of these clowns. We don't deserve it but we may well suffer for it.

I'm not being obtuse, but didn't read "3rd party" as meaning a "3rd party ownership" but a "3rd party as in not me or you." Man Utd would be a third party if Rovers asked SEM to enquire about one of their players. If the board hadn't been consulted and SEM were asked to ask Gill about the availability of Giggs on behalf of the Venkys, that fits the language used in the letter.

Don't get me wrong, the entire thing stinks and is utterly the wrong way to run the club.

If my interpretation of "3rd party" is the wrong one, and it's "3rd party ownership" then it is dire.

I predict that this time next week, nothing will have have happened and this will be forgotten about.

If this becomes widely reported as I expect it to be, the PL will have to become involved, they wont have an option, either that or the PL management will be forced to resign en block!!

This letter should also be sent to the PL/LMA/SSN etc along with a request for an apology to Rovers fans!!

Maybe the stories of Rovers being under investigation , subsequently confirmed as not being the case, were just a few months late? In which case the PL may well have already closed that file 12 months ago?

Big Sam needs to pop in an FOI request regarding his dismissal - now that could be explosive

We're not government owned, so FOI isn't applicable.

A DPA request on the other hand could be rather revealing (but would have to be done by Sam himself, not by anyone else).

Now if the Premier League dont investigate this, there really is something fishy going on, I couldnt post this before, but I mentioned a few weeks back that there was some investigative journalism going on, how they got a copy of the letter, I dont know, but I believe this is why Anderson gave the interview on SSN last week when it became clear this letter was in the hands of others!!

There would have been at least 3 copies of that we can be certain plus no doubt further copies forwarded to other board members, SA and quite possibly Rothschilds and contacts at Prem League HQ! I'd imagine that the Fat Controller's legal team can be doing nothing about this but running up a massive bill for the slimy btstrd! No wonder he was red eyed and sobbing.... Family reasons my arse! I hope he gets nailed over this but the consequence could be that it will take the Slumdogs and obviously by association BRFC down with him.

An example of get rich quick greed and nothing else. Somebody with those worldwide connections and honourable intentions working hand in hand with SA and JW could have really had us buzzing. Was never going to be enough for Dastardly and Muttley though was it?

My thoughts as well....

Perhaps she was as flabbergasted as we were with the JA interview on Sky and feels that She needs to start to come clean about how they were misled by their 'advisors'

Hopefully this is the tip of the iceberg.

That wouldn't explain the Fat Controller doing the interview though. He knew something was going to blow and was not instigating it but rather trying to dust off his fingerprints. I assume that our financial status will be key to all this happening now imo. Just musing but I wonder if someone promised money has not received any and they are about to blow the whistle.

Exciting stuff on the pitch yesterday isn't half as exciting as this..... exciting as in being on a bus that has left the road and is see sawing over a precipice.!

Interesting Laws governing Company Directors!

Directors don’t have to be shareholders or even employees of the company. If you do work full or part-time for the company, however, you may need to have a director’s service contract. You may need to register this, and keep a copy for inspection at the company’s registered office.

Be aware that if someone effectively acts as a director, whether or not they have the title, they may be regarded legally as a director. For example, this applies to someone, other than an expert specialist adviser, on whose advice the directors of a company are accustomed to act. This person may be viewed as a shadow director.

Duties of a director

Directors hold a position of trust on behalf of shareholders and direct the company’s operations on their behalf. They act through the Board, which usually controls company business.

The extent of the directors’ authority depends on the company’s Articles of Association. Before you become a director, take legal advice on the extent of your obligations.

As a director, you have several duties:

To act within your powers and make sure the company follows its constitution as set out in the Memorandum and Articles of Association.

To act in good faith to promote the success of the company for the benefit of its members. You must also have take into consideration employees, suppliers, customers, the environment and the community.

To carry out your duties with reasonable care and skill. Higher standards may be expected from executive directors who are responsible for an area in which they have a specialist or professional qualification.

To exercise independent judgement.

To make sure that there is no conflict of interest and duty. You must not take bribes, and must disclose any personal interests to the company. You must not divert business opportunities to yourself that ought to be available to the whole company.

To make a declaration of interest where appropriate. You may not be allowed to vote on matters if there is a conflict of interests.

Not to benefit from a third party by reason of your being a director, or by doing or not doing something.

Not to act with intent to defraud creditors or for any other fraudulent purpose.

Not to engage in wrongful trading, that is, allowing the company to carry on trading when you know (or ought to know) that it is insolvent. This can lead to personal liability.

To carry out the statutory obligations imposed by the Companies Act 2006 and other legislation.

Directors are personally liable for certain actions taken while fulfilling their duties. Several laws give rights of action against directors in their personal

1. That may be the case.

2. You genuinely did - good and proper.

3. "Most respects" I seriously don't doubt you will be in the right ballpark, but you have also done your fair share of increasing hysteria on this site by blurring guesswork, opinion and facts.

I agree with hre about hysterics with people on this site and trying to make trouble.

But in light of this information it just finally puts reason for that ridiculous interview JA gave.

But it clearly sem that have been doing the dodgy here. And by his own admittance during this time he slept at brochall.

I think the interview was bad pr it has just put him in the spotlight.

That's exactly what I was thinking. Something has spooked him and he's thought better get the interview in!

I dont think it will be venkys who will be investigated here they have been duped and as letter hints its sem and have were doing the naughty.

Rising agent fee's, strangely timed interview, and the main man involved from sem....Do another interview denying any wrong doing, do another!

Jerome could now get what he deserves horrible little slime ball, and hopefully Kean aswell.

OH VENKYS! If only you had listened to the people who sighned this letter!!!

Instead of slimeballs who made you spend more than you thought and all the money went to themselves and they ran away.

Can there not be a common sense/IQ test in take-over's from now on??

Problem is, Nick Harris only wrote the article AFTER the JA interview and the existence of that letter (but not the actual letter itself) has been known about for many many months, so JA's interview can't be a response to him knowing this was going public.

Surley JA would have know or have contacts that would have informed him that this letter was in existance and from his point of view this information had fallen into the "wrong hands"

And with the interview and Getting lawyer's involved is a futile attempt to sweep this under the carpet and stop and hint of him having any involvement

all just my opinion of course maybe im looking at it the wrong way

How the hell has such an important letter like this got into the public domain?...surely this has been timed perfectly by someone VERY close to the club. The strange and totally unexpected Anderson interview etc all now falls perfectly in place it would appear.....

The infamous 'Ewood mole' strikes again?

Or someone that used to be very close to the club.

The letter is evidence of what we've known for months. Sam's sacking marginalised the board of directors at the time and a fall out ensued between the board and owners, which resulted in them leaving. Nicko had the story about Formica's third party issues a year ago.

Timing of the letter being leaked more interesting than the actual letter.

It also constitutes the first written evidence in public of probable rule breaking and raises an absolute mountain of questions about Steve Kean and when and how his relationship with Mrs Desai became so close.

I personally am struggling to find any logical explanation which is consistent with Kean not being close with Mrs D prior to 21 November 2010.
