Mike Graham Posted December 31, 2012 Posted December 31, 2012 Anyone who's paid out on the basis that they won't reveal any info about their previous employment would lose their dough in a civil suit + would potentially face legal costs + any possible penalties.Best bet for a reveal is if Big Sam refuses to listen to any offers and takes Kean and the Club to court. I have advised on many Compromise Agreements (NDA's) and while they all have confidentiality clauses they are very difficult to enforce if they are breeched as the employer would have to go to the County Court which is public and therefore the issues would be even more public. What stops individuals talking are two issues: they are frightened (to lose their cash); and they do not want to be seen as a person who goes straight to the press and therefore would put off potential future employers.
